End User License Agreement (EULA)

Marbas & Co — Software Applications

1. Parties

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Martin Berg / Marbas & Co ("Licensor") regarding your use of any software application made available by Marbas & Co on the official download page, including but not limited to Simply Text and Recall (collectively referred to as "the Application").

By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement.

2. Grant of License

The Licensor grants you a free, non-exclusive, non-transferable license to download and use the Application for personal or commercial purposes, subject to the terms and conditions of this Agreement.

3. No Warranty — Use As Is

The Application is provided "as is", without warranty of any kind, express or implied. The Licensor makes no guarantees regarding:

Fitness for a particular purpose
Uninterrupted or error-free operation
Accuracy or reliability of results

The User has no right to claim updates, bug fixes, patches, or any future improvements. Any updates provided are at the sole discretion of the Licensor.

4. Limitation of Liability

To the fullest extent permitted by applicable law, the Licensor shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the Application, including but not limited to:

Data loss or corruption
System damage or failure
Loss of business or revenue

Use of the Application is entirely at your own risk.

5. Redistribution

Redistribution of the Application is permitted under the following conditions:

The Application is distributed free of charge
The original download source (Marbas & Co official download page) is clearly referenced and shared alongside the Application
The Application is distributed unmodified and in its original form
All terms of this Agreement remain intact and are communicated to recipients

6. Restrictions

You may not:

Sell the Application or charge any fee for access to it
Claim ownership or authorship of the Application
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application
Modify or create derivative works based on the Application
Use the Application for any illegal or malicious purposes, including but not limited to unauthorized data collection, distribution of malware, or any activity violating applicable law

7. Ownership & Intellectual Property

The Application and all associated intellectual property rights are and remain the exclusive property of Martin Berg / Marbas & Co. All rights not expressly granted in this Agreement are reserved by the Licensor.

This Agreement does not transfer any ownership rights to the User.

8. Changes to This Agreement

The Licensor reserves the right to modify the terms of this Agreement at any time, including introducing paid licensing for future versions of the Application. Changes will apply to new versions of the Application going forward.

Continued use of a previously downloaded version of the Application is governed by the Agreement version in effect at the time of download.

9. Termination

This Agreement is effective until terminated. The Licensor may terminate this Agreement immediately and without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Application and delete all copies in your possession.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Sweden.
